Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and BanksRates Ltd. (“banks-rates.com”, “we”, “us”, “our”), the operator of the website banks-rates.com and the related services described below (together, the “Service”). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

banks-rates.com is an informational tool that fetches and republishes official foreign-exchange reference rates published by national central banks and similar public authorities. Given a bank, a date, an amount and a currency, the Service returns the corresponding value in the bank’s national currency, together with the value on the previous business day. The Service is offered through several surfaces, including:

  • the website at banks-rates.com;
  • the HTTP API at api.banks-rates.com (the “API”);
  • the Telegram mini-app;
  • the developer console at console.banks-rates.com (the “Console”); and
  • other interfaces we may offer from time to time.

2. Not financial advice; accuracy

The exchange-rate data is sourced from third-party central banks and other public authorities. It is provided for general information only and is not financial, investment, accounting, tax, legal or any other professional advice, and is not an offer, solicitation or recommendation to enter into any transaction.

We do not create the underlying rates and cannot guarantee that they are accurate, complete, current or uninterrupted. Rates may be delayed, may differ from the rate applied by any bank, broker or payment provider to an actual transaction, and may be revised or withdrawn by the source authority at any time. You must not rely on the Service for trading, settlement, accounting, regulatory or any decision that has financial or legal consequences, and you are solely responsible for independently verifying any figure before relying on it.

3. Eligibility and accounts

You may browse the public website without an account. Issuing API keys and using the Console requires an account, which you create by signing in with a supported identity provider (Google, GitHub, Telegram or LinkedIn) or via an email sign-in link. You must be at least 16 years old (or the age of digital consent in your country, if higher) to create an account.

You are responsible for all activity under your account and for keeping your sign-in methods and API keys confidential. API keys are credentials: treat them like passwords, do not share or embed them in public code, and revoke any key you believe is compromised. Notify us promptly of any unauthorised use. You must provide accurate information and may not impersonate any person or misrepresent your affiliation.

4. Plans, rate limits and fair use

The Service is currently provided free of charge. Use is subject to rate limits that depend on your plan, for example (current values, which we may change):

  • unauthenticated requests (no API key): limited per IP address; and
  • requests authenticated with a registered API key: higher per-minute, per-hour and per-day allowances.

You agree not to circumvent or attempt to circumvent rate limits, access controls or usage quotas (for example by rotating IP addresses, keys or accounts), and not to place an unreasonable load on the Service. We may introduce, change or discontinue plans, limits or fees at any time on a prospective basis.

5. Acceptable use

You agree that you will not, and will not permit anyone to:

  • use the Service in violation of any applicable law, regulation or third-party right;
  • interfere with, disrupt, probe, overload or attempt to gain unauthorised access to the Service, its infrastructure or other users’ accounts or data;
  • reverse engineer, decompile or attempt to extract source code, except to the extent this restriction is prohibited by applicable law;
  • scrape, harvest or bulk-download data other than through the documented API and within your applicable limits;
  • resell, sublicense or redistribute the Service or substantial portions of its output as a stand-alone product that competes with the Service, or misrepresent the source of the data; or
  • remove or obscure any proprietary notices.

6. Intellectual property

Individual exchange-rate figures are facts published by public authorities and are not owned by us. However, the Service software, design, branding, documentation, and the selection, arrangement and presentation of data are owned by us or our licensors and are protected by intellectual-property laws.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Service and the data it returns for your internal or personal use, including in your own applications via the API. If you display rates obtained from the Service, you must attribute the underlying source authority and comply with that authority’s own terms.

7. Third-party services, links and advertising

The website may display advertising served by third parties (including Google AdSense) and may contain links to third-party sites and services, including the identity providers used for sign-in. We do not control and are not responsible for third-party content, products, policies or practices. Your use of third-party services is governed by their own terms and privacy policies. How we handle personal data is described in our Privacy Policy.

8. Availability and changes to the Service

The Service is provided on an “as available” basis. We may modify, suspend or discontinue all or part of the Service, including any surface, plan, endpoint or data source, at any time, with or without notice. We are not liable to you for any modification, suspension or discontinuation.

9. Disclaimer of warranties

To the maximum extent permitted by law, the Service and all data are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, secure, error-free or that data will be accurate or current. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or other intangible losses, arising out of or relating to your use of or inability to use the Service, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months preceding the claim (which, for a free service, is zero) or one hundred euros (€100). Nothing in these Terms limits liability that cannot be limited under applicable law (such as for death or personal injury caused by negligence, or fraud).

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

12. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access, or revoke API keys, at any time if you breach these Terms, if required by law, or to protect the Service or its users. On termination, the licences granted to you end and Sections that by their nature should survive (including 2, 6, and 9–14) survive.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms here and update the “Last updated” date. Material changes will take effect no earlier than the date posted, and your continued use of the Service after they take effect constitutes acceptance.

14. Governing law and disputes

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of Poland, without regard to its conflict-of-laws rules, and the courts located in Poland have exclusive jurisdiction, subject to any mandatory consumer-protection rights you have in your country of residence.
